Facebook reserves 77 million euros Irish WhatsApp subsidiary to pay possible data protection fines in Europe: Facebook is aware that some European fines may be falling, and that's why they set aside more than 77 million euros in their accounts of the Irish subsidiary of WhatsApp last year.

To understand the origin of everything, you have to turn to Max Schrems, an Austrian privacy activist who is also one of the worst nightmares for Facebook.

In October 2015, the Court of Justice of the European Union ruled in the Schrems case and overturned the Safe Harbor agreement between the United States and the Old Continent, which guaranteed the transfer of data from European users to North America. Schrems has been litigating against Facebook since 2011, when he launched an NGO, now known as noyb.

In July this year, the CJEU has again failed against the big tech companies at the behest of Schrems. The Schrems II judgment overturns the agreement that was born after Safe Harbor, Privacy Shield, and understands that the transfers of data from European users to the USA are illegal because there the data processing does not have the same standards and the same guarantees that are reserved in Europe.

In spite of this, technology companies such as Facebook and Google have continued to transfer data from European citizens to their parents in the United States at the request of a legal mechanism called Standard Contractual Clauses, the SCC for its acronym in English. Noyb, the Schrems NGO, has filed a hundred complaints against technology in the various European data protection bodies to end this.

And yet, at the moment the fines have not arrived. Although they could arrive before the end of the year.

It is what follows from a move that WhatsApp made last year, and that has been reflected in their accounts now. According to the Irish Times, WhatsApp Ireland recorded losses of 11,2 million euros last year after setting aside 77,5 million to face the sanctions that may now arrive.

According to the Irish media, the company, owned by Facebook, established this subsidiary in Ireland in 2017. Its role is to be the data funnel of Europeans who use WhatsApp, and provide its service to other Facebook companies. It has only 20 employees.

WhatsApp Ireland's expenses soared last year by up to 86,2 million, because the Facebook subsidiary decided to make provision for 77,5 million for "possible administrative penalties derived from compliance in the new regulations that are now under investigation".

"The provisions made are based on the advice of external lawyers, the research of regulators carried out between 2019 and 2020, and important legal disputes as well as other factors, which under current legislation could entail administrative sanctions," the company said at the time. The current legislation to which they refer is the European Data Protection Regulation, the GDPR which came into force in May 2018.

The GDPR provides for penalties of up to 20 million euros or 4% of the total annual turnover of the previous financial year of the infringer. Facebook was already fined 5,000 million dollars in the United States last summer, for the Cambridge Analytica scandal.

The first sanction that Facebook could face would come, precisely, from the Irish Data Protection Commission. This body, the namesake of the Spanish Data Protection Agency, has been harshly criticized by the Austrian activist, Schrems, who has accused them of slowing down and delaying the processes against the big tech companies.

Despite these criticisms, which have happened in the past, Schrems has not stopped in his efforts. After hearing the Schrems II judgment of July this year, con noyb decided to denounce to several bodies that these platforms continued to take advantage of legal nooks and crannies to transfer user data to the US. Schrems especially pointed to Google and Facebook.

It soon became known that the DPC, the Irish body, had put on the table a veto on such transfers in order to effectively comply with the judgment of the CJEU. And the head of Data Protection of Facebook Ireland went out of her way assuring that the company would not know how the social network could continue in the Old Continent in such a way.
